Welcome aboard My Daily Driver

At My Daily Driver, every journey is designed to be a comfortable and perfectly controlled experience.

These Terms and Conditions of Sale are intended to provide you with transparent information about the contractual framework applicable to our services, in order to guarantee a clear and secure relationship.

My Daily Driver offers a high-end private transportation service that meets international quality standards, combining punctuality, safety, confidentiality, and operational excellence, serving a demanding clientele of both professionals and individuals.

1. Purpose and scope

These General Terms and Conditions of Sale (hereinafter the "GTC") define the respective rights and obligations of My Daily Driver and its customers in connection with the booking and performance of the transportation services offered.

They apply to all orders or reservations made:

  • via the website,
  • by email,
  • via contact forms,
  • by messaging (SMS, WhatsApp, applications),
  • or through professional partners.

All reservations imply the customer's acceptance of these T&Cs, under the conditions specified in Article 3.

2. Nature of the services offered

My Daily Driver offers the following services in particular:

  • Private transfers: Airports, train stations, hotels, business or personal meeting places.
  • Provision of vehicles with drivers: By the hour, half-day, or full day, for business, events, or personal needs.
  • Tailor-made sightseeing tours and excursions: Personalized services, with dedicated support and tailored itineraries.
  • Event and corporate services: Logistical coordination, multi-vehicle management, tailored B2B billing.
  • Ticket purchases or related services: Related services (tickets, access, third-party services), when expressly offered and confirmed.

Each service is provided with a focus on premium service, with particular attention paid to passenger comfort, schedule reliability, and driver discretion.

3. Acceptance of the General Terms and Conditions of Sale

Any reservation made with My Daily Driver, regardless of the channel used (website, email, contact form, messaging, or professional partner), implies express and unreserved acceptance of these General Terms and Conditions of Sale.

This acceptance is formalized:

  • by a dedicated checkbox or
  • by an electronic signature,

collected prior to any payment.

For traceability purposes, My Daily Driver keeps a time-stamped and secure proof of this acceptance within its internal systems, in accordance with applicable legal requirements.

When the reservation is made by a professional customer, acceptance of these GTC also applies to the final beneficiary of the service, unless otherwise expressly agreed.

4. Formation of the contract and booking process

The transport service contract is validly formed between the customer and My Daily Driver at the end of the booking process described below.

4.1. Booking request

The customer may request a service:

  • via the secure My Daily Driver website,
  • using a contact form,
  • or following a personalized quote sent by email or instant messaging.

All requests are subject to availability and feasibility checks by My Daily Driver.

4.2. Validation, confirmation, and payment

The reservation becomes effective:

  • either after express validation of the quote by the customer,
  • and receipt of payment, made via a secure payment link or by bank transfer, depending on the chosen method.

No definitive contractual commitment is formed before this stage.

4.3. Acknowledgment of receipt and contractual commitment

The sending of a confirmation message (e-mail or automatic message) by My Daily Driver constitutes:

  • confirmation of coverage for the service,
  • and firm and definitive acceptance of the reservation.

Upon sending this confirmation, the contract is deemed to be legally binding and binding on the parties.

4.4. Driver information and service tracking

The contact details of the driver assigned to the service (name, phone number, and vehicle registration number) are provided to the customer approximately 12 hours before the service is performed.

For reasons of service quality, any requests for changes, clarifications, or complaints must be addressed exclusively to My Daily Driver's customer service department, and not directly to the driver.

5. Cancellation, modification, and refund

We understand that schedules can change. In order to guarantee reliable organization, the availability of drivers, and a level of service that meets My Daily Driver standards, the following cancellation policy applies in a clear and transparent manner.

Cancellation deadlines are assessed in relation to the scheduled pick-up time.

5.1. Simple transfers

  • Cancellation is possible up to 48 hours before pick-up. A flat fee corresponding to 20% of the total price will be retained by My Daily Driver to cover administrative and service mobilization costs.
  • After this deadline, the service will be charged in full.

This rule ensures the availability of the vehicle and driver specifically reserved for the journey in question.

5.2. Provision of a vehicle with driver

  • Cancellation possible up to 48 hours before pick-up. A flat fee equivalent to 20% of the total price will be retained to cover preparation and organization costs.
  • After this period, the service is payable in full.

5.3. Excursions and sightseeing tours

Excursions and sightseeing tours require additional logistical organization (dedicated vehicles, drivers, external service providers).

The following conditions apply:

  • No cancellation or refund is possible within 10 days prior to the service.
  • When the service requires specific resources (dedicated vehicles (Class-S Sedan, Sprinter Minibus, Bus), drivers booked in advance, special coordination), the cancellation period is extended to 30 days.

In the event of cancellation within the authorized time frame, the following fees will be charged:

  • More than 30 days before the scheduled date: 10% of the total amount
  • Between 30 days and 11 days before the service: 30% of the total amount
  • 10 days or less before: 100% of the total amount

Fees are calculated on the total amount including tax for the service, as confirmed at the time of booking.

These amounts correspond to the costs already incurred for the preparation and logistics of the service.

Important:
Tickets, entrance fees, guide services, or any third-party services included are non-cancellable, non-refundable and non-modifiable, regardless of the date of cancellation.

5.4. Peak season

During certain periods of high demand, expressly identified in advance by My Daily Driver (including Paris Fashion Week, Paris Air Show, Roland Garros, Events and trade shows at the Villepinte Exhibition Center, Events and trade shows at Paris Expo Porte de Versailles, Events at Stade de France, Events at Parc des Prince, Bastille Day, Fête de la Musique), reservations are firm and non-cancellable once they have been confirmed.

However, cancellation remains possible in the event of:

  • force majeure, as defined in Article 1218 of the Civil Code,
  • or proven fault on the part of the service provider.

The updated list of these periods is available:

  • on the My Daily Driver website,
  • and directly mentioned on the quote or booking confirmation.

5.5. Customer absence (no-show) and waiting times included

If the customer is absent at the pick-up location, the following waiting times are included:

  • Airports: Waiting time included for 60 minutes from the actual flight landing time.
  • Other pick-up locations (train stations, hotels, private addresses): Waiting time included for 15 minutes from the agreed time.

Beyond these time limits, and without prior notification to the customer, the service is deemed to have been performed and invoiced in full.

5.6. Cancellation by My Daily Driver

In the event of an exceptional event beyond the control of My Daily Driver (breakdown, unforeseeable unavailability, force majeure), the customer will be offered the choice of:

  • a postponement at no extra cost to a date or time agreed upon by mutual agreement,
  • or a full refund of the sums paid, made within a maximum of 10 working days.

5.7. No right of withdrawal

Consumers are informed that, in accordance with Article L.221-28, 12° of the French Consumer Code, the right of withdrawal cannot be exercised for transport services that must be provided on a specific date or during a specific period.

Consequently, any confirmed order for a dated service is firm and final and cannot be subject to a right of withdrawal.

5.8. High-value services

For any service costing more than €3,000, the cancellation period without charge is extended to 30 days before the scheduled date, in order to cover the logistical and organizational costs specific to this type of service.

6. Booking changes

At My Daily Driver, we are flexible when your circumstances change, while ensuring rigorous organization and the availability of the resources mobilized.
Change requests are processed according to the conditions below, assessed in relation to the originally scheduled pick-up time.

6.1. Changes at no extra cost (up to 48 hours before the service)

Up to 48 hours before the service, the following changes can be made free of charge:

  • updating passenger details (name, telephone number, email address),
  • correction or update of flight or train information,
  • addition or modification of useful information to be communicated to the driver.

These adjustments do not affect the logistical organization of the service.

6.2. Changes with price adjustments (up to 48 hours before the service)

The following changes may result in a price adjustment, depending on their impact on the organization of the service:

  • change of date or time,
  • change in the duration of the service,
  • change in pick-up location or destination,
  • change in the type of vehicle or number of passengers.

In such cases, a new rate will always be communicated to the customer before any confirmation. If necessary, a secure additional payment link may be sent.

6.3. Change requests less than 48 hours in advance

Less than 48 hours before the scheduled time, any change request will be reviewed on a case-by-case basis, with no guarantee of feasibility.

Whether it is accepted depends on:

  • the availability of drivers,
  • operational constraints,
  • and the level of mobilization already committed.

6.4. Postponement of service less than 48 hours in advance

When a customer requests the postponement of their service less than 48 hours before the initial schedule, this request does not constitute a cancellation.

My Daily Driver may, on an exceptional basis and at its sole discretion, offer a postponement to a later date, subject to availability, within a maximum period of six (6) months from the date initially scheduled.

In this case:

  • the sums already paid shall be retained,
  • they will be converted into a credit note for an equivalent amount,
  • this credit is non-transferable, non-refundable, and can be used for any My Daily Driver service.

If the customer does not confirm a postponement within this six-month period, the sums paid will remain definitively acquired by My Daily Driver.

7. "Last minute" surcharge

Any reservation confirmed less than 24 hours before the scheduled pick-up time will incur a surcharge, justified by the immediate and exceptional mobilization of the resources necessary to perform the service.

This surcharge is, for information purposes only:

  • at least 30% for simple transfers,
  • at least 50% for tours, excursions, or complex services.

The exact amount of the surcharge is always communicated before payment is confirmed and is clearly stated on the corresponding quote or invoice.

8. Discounted offers and promotions

Offers benefiting from a discounted or promotional rate are subject to specific conditions, relating to their firm and non-refundable nature, unless otherwise required by law.

Each quote or booking confirmation expressly states the following:

"The discounted price is firm and non-refundable, subject to applicable legal rights (breach of contract, force majeure, or proven fault on the part of the service provider)."

This stipulation does not in any way deprive the customer of their legal rights to reimbursement when the service has not been performed in accordance with the contract or in the event of a breach attributable to My Daily Driver.

9. Specific conditions applicable to business customers

(Hotels, concierge services, partner companies – "key accounts")

Professional partner customers can benefit from a premium framework contract, including the following conditions:

  • Consolidated monthly invoicing, issued on the last day of each month for all services provided;
  • Payment term: 30 days from the invoice date, in accordance with Article L.441-10 of the French Commercial Code;
  • Late payment penalties, payable automatically and without reminder:
    • interest calculated at the European Central Bank (ECB) refinancing rate, plus 10 points,
    • a fixed compensation of €40 for collection costs;
  • Automatic suspension of services in the event of non-payment, until the balance has been paid in full.

These conditions may be specified, adapted, or supplemented by the specific provisions of the specific framework agreement entered into with the professional customer concerned.

10. Force majeure

My Daily Driver cannot be held liable for the non-performance or delay of a service resulting from an event of force majeure, within the meaning of Article 1218 of the Civil Code.

The following, among others, are considered cases of force majeure, without this list being exhaustive:

  • strikes affecting transport, airports, or public services,
  • exceptional weather conditions or severe storms,
  • roadblocks, demonstrations, or administrative restrictions,
  • unforeseeable cancellation or delay of flights or trains not attributable to My Daily Driver,
  • major breakdowns or accidents beyond the control of the service provider.

In the event of force majeure:

  • no compensation may be claimed,
  • a postponement of the service may be offered when this is materially possible.

The following do not constitute cases of force majeure: illness or personal unavailability of the customer, booking errors, foreseeable delays, or any event relating solely to the customer's organization.

11. Rules applicable on board vehicles

In order to ensure the safety and comfort of all, the following rules apply strictly on board:

  • seat belts must be worn,
  • smoking is strictly prohibited, including electronic cigarettes,
  • Respectful behavior is required towards the driver and other passengers.
  • any damage or abnormal soiling may result in a repair charge, upon presentation of proof,
  • Animals are not allowed, with the exception of assistance animals, which must be transported in a suitable carrier.
  • Child seats are provided upon prior request, subject to availability, and may incur additional charges.

My Daily Driver reserves the right to immediately terminate the service in the event of dangerous, inappropriate, or unlawful behavior.
In this case, no refund will be due and the company reserves the right to claim compensation for any material or moral damage suffered.

12. Protection of personal data

My Daily Driver processes only the personal data strictly necessary for the performance of its services, in accordance with the General Data Protection Regulation (GDPR).

Processing is limited to the following purposes:

  • reservation management,
  • logistical organization and driver communication,
  • billing and customer follow-up,
  • improvement of service quality.

Certain specific data (in particular the age of children for on-board equipment or the geolocation of salaried drivers) are processed on the basis of the customer's explicit consent.

The rights of data subjects (access, rectification, erasure, restriction, objection, portability) and the procedures for exercising these rights are detailed in the Privacy Policy, which is available on the website or by contacting: rgpd@mydailydriver.fr

13. Applicable law and dispute resolution

These General Terms and Conditions of Sale are subject to French law.
The French version shall prevail in the event of any difference in interpretation.

In the event of a dispute relating to the execution or interpretation of these terms and conditions, the customer is invited to contact My Daily Driver in the first instance in order to seek an amicable solution.

In accordance with Articles L.612-1 et seq. of the French Consumer Code, any customer who is a consumer may have recourse to a consumer mediator free of charge, after a prior written complaint addressed to My Daily Driver has failed.

In the absence of an amicable agreement:

  • for consumer customers, the dispute will be brought before the competent court in accordance with the rules of common law;
  • for professional customers, jurisdiction is assigned to the materially competent court in the jurisdiction of Créteil, unless otherwise stipulated in the contract.

My Daily Driver's liability, for all causes combined, is strictly limited to the total amount including tax of the service concerned, except in cases of gross negligence or fraud.

14. Publication, proof, and archiving

These GTC are available for consultation at any time at:

  • https://www.mydailydriver.fr/fr/cgv
  • https://www.mydailydriver.fr/en/terms-conditions

Their acceptance is recorded and time-stamped.

Electronic exchanges (emails, text messages, instant messaging), booking confirmations, and payment records are binding between the parties, in accordance with Article 1366 of the Civil Code.

Proof of payment and acceptance are securely archived via the payment provider Stripe and constitute acknowledgment of debt within the meaning of Article 1353 of the Civil Code.
