These Terms and Conditions of Sale are intended to provide you with transparent information about the contractual framework applicable to our services, in order to guarantee a clear and secure relationship.
My Daily Driver offers a high-end private transportation service that meets international quality standards, combining punctuality, safety, confidentiality, and operational excellence, serving a demanding clientele of both professionals and individuals.
These General Terms and Conditions of Sale (hereinafter the "GTC") define the respective rights and obligations of My Daily Driver and its customers in connection with the booking and performance of the transportation services offered.

All reservations imply the customer's acceptance of these T&Cs, under the conditions specified in Article 3.
My Daily Driver offers the following services in particular:
Each service is provided with a focus on premium service, with particular attention paid to passenger comfort, schedule reliability, and driver discretion.
Any reservation made with My Daily Driver, regardless of the channel used (website, email, contact form, messaging, or professional partner), implies express and unreserved acceptance of these General Terms and Conditions of Sale.
This acceptance is formalized:

For traceability purposes, My Daily Driver keeps a time-stamped and secure proof of this acceptance within its internal systems, in accordance with applicable legal requirements.
When the reservation is made by a professional customer, acceptance of these GTC also applies to the final beneficiary of the service, unless otherwise expressly agreed.
The transport service contract is validly formed between the customer and My Daily Driver at the end of the booking process described below.
The customer may request a service:
All requests are subject to availability and feasibility checks by My Daily Driver.
The reservation becomes effective:
No definitive contractual commitment is formed before this stage.
The sending of a confirmation message (e-mail or automatic message) by My Daily Driver constitutes:
Upon sending this confirmation, the contract is deemed to be legally binding and binding on the parties.
The contact details of the driver assigned to the service (name, phone number, and vehicle registration number) are provided to the customer approximately 12 hours before the service is performed.
For reasons of service quality, any requests for changes, clarifications, or complaints must be addressed exclusively to My Daily Driver's customer service department, and not directly to the driver.
We understand that schedules can change. In order to guarantee reliable organization, the availability of drivers, and a level of service that meets My Daily Driver standards, the following cancellation policy applies in a clear and transparent manner.
Cancellation deadlines are assessed in relation to the scheduled pick-up time.
This rule ensures the availability of the vehicle and driver specifically reserved for the journey in question.
Excursions and sightseeing tours require additional logistical organization (dedicated vehicles, drivers, external service providers).

In the event of cancellation within the authorized time frame, the following fees will be charged:
Fees are calculated on the total amount including tax for the service, as confirmed at the time of booking.
These amounts correspond to the costs already incurred for the preparation and logistics of the service.
Important:
Tickets, entrance fees, guide services, or any third-party services included are non-cancellable, non-refundable and non-modifiable, regardless of the date of cancellation.
During certain periods of high demand, expressly identified in advance by My Daily Driver (including Paris Fashion Week, Paris Air Show, Roland Garros, Events and trade shows at the Villepinte Exhibition Center, Events and trade shows at Paris Expo Porte de Versailles, Events at Stade de France, Events at Parc des Prince, Bastille Day, Fête de la Musique), reservations are firm and non-cancellable once they have been confirmed.
However, cancellation remains possible in the event of:

If the customer is absent at the pick-up location, the following waiting times are included:
Beyond these time limits, and without prior notification to the customer, the service is deemed to have been performed and invoiced in full.
In the event of an exceptional event beyond the control of My Daily Driver (breakdown, unforeseeable unavailability, force majeure), the customer will be offered the choice of:
Consumers are informed that, in accordance with Article L.221-28, 12° of the French Consumer Code, the right of withdrawal cannot be exercised for transport services that must be provided on a specific date or during a specific period.
Consequently, any confirmed order for a dated service is firm and final and cannot be subject to a right of withdrawal.
For any service costing more than €3,000, the cancellation period without charge is extended to 30 days before the scheduled date, in order to cover the logistical and organizational costs specific to this type of service.
At My Daily Driver, we are flexible when your circumstances change, while ensuring rigorous organization and the availability of the resources mobilized.
Change requests are processed according to the conditions below, assessed in relation to the originally scheduled pick-up time.
Up to 48 hours before the service, the following changes can be made free of charge:
These adjustments do not affect the logistical organization of the service.
The following changes may result in a price adjustment, depending on their impact on the organization of the service:
In such cases, a new rate will always be communicated to the customer before any confirmation. If necessary, a secure additional payment link may be sent.
Less than 48 hours before the scheduled time, any change request will be reviewed on a case-by-case basis, with no guarantee of feasibility.
Whether it is accepted depends on:
When a customer requests the postponement of their service less than 48 hours before the initial schedule, this request does not constitute a cancellation.
My Daily Driver may, on an exceptional basis and at its sole discretion, offer a postponement to a later date, subject to availability, within a maximum period of six (6) months from the date initially scheduled.
In this case:
If the customer does not confirm a postponement within this six-month period, the sums paid will remain definitively acquired by My Daily Driver.
Any reservation confirmed less than 24 hours before the scheduled pick-up time will incur a surcharge, justified by the immediate and exceptional mobilization of the resources necessary to perform the service.
This surcharge is, for information purposes only:
The exact amount of the surcharge is always communicated before payment is confirmed and is clearly stated on the corresponding quote or invoice.
Offers benefiting from a discounted or promotional rate are subject to specific conditions, relating to their firm and non-refundable nature, unless otherwise required by law.
Each quote or booking confirmation expressly states the following:
"The discounted price is firm and non-refundable, subject to applicable legal rights (breach of contract, force majeure, or proven fault on the part of the service provider)."
This stipulation does not in any way deprive the customer of their legal rights to reimbursement when the service has not been performed in accordance with the contract or in the event of a breach attributable to My Daily Driver.

Professional partner customers can benefit from a premium framework contract, including the following conditions:
These conditions may be specified, adapted, or supplemented by the specific provisions of the specific framework agreement entered into with the professional customer concerned.
My Daily Driver cannot be held liable for the non-performance or delay of a service resulting from an event of force majeure, within the meaning of Article 1218 of the Civil Code.

The following do not constitute cases of force majeure: illness or personal unavailability of the customer, booking errors, foreseeable delays, or any event relating solely to the customer's organization.
In order to ensure the safety and comfort of all, the following rules apply strictly on board:
My Daily Driver reserves the right to immediately terminate the service in the event of dangerous, inappropriate, or unlawful behavior.
In this case, no refund will be due and the company reserves the right to claim compensation for any material or moral damage suffered.
My Daily Driver processes only the personal data strictly necessary for the performance of its services, in accordance with the General Data Protection Regulation (GDPR).
Processing is limited to the following purposes:
Certain specific data (in particular the age of children for on-board equipment or the geolocation of salaried drivers) are processed on the basis of the customer's explicit consent.
The rights of data subjects (access, rectification, erasure, restriction, objection, portability) and the procedures for exercising these rights are detailed in the Privacy Policy, which is available on the website or by contacting: rgpd@mydailydriver.fr
These General Terms and Conditions of Sale are subject to French law.
The French version shall prevail in the event of any difference in interpretation.
In the event of a dispute relating to the execution or interpretation of these terms and conditions, the customer is invited to contact My Daily Driver in the first instance in order to seek an amicable solution.
In accordance with Articles L.612-1 et seq. of the French Consumer Code, any customer who is a consumer may have recourse to a consumer mediator free of charge, after a prior written complaint addressed to My Daily Driver has failed.

In the absence of an amicable agreement:
My Daily Driver's liability, for all causes combined, is strictly limited to the total amount including tax of the service concerned, except in cases of gross negligence or fraud.

Their acceptance is recorded and time-stamped.
Electronic exchanges (emails, text messages, instant messaging), booking confirmations, and payment records are binding between the parties, in accordance with Article 1366 of the Civil Code.
Proof of payment and acceptance are securely archived via the payment provider Stripe and constitute acknowledgment of debt within the meaning of Article 1353 of the Civil Code.
